Rights and Protections for NDIS Participants in PBS


The NDIS framework places a strong emphasis on the human rights and protections of participants, especially when it comes to managing behaviours of concern.

Upholding Participant Rights

Under the NDIS, participants have the right to:

  • Informed choice and control over their supports.

  • Receive person-centred and respectful care.

  • Have their behaviour support strategies align with their values and preferences.

  • Be free from the unnecessary use of restrictive practices​​.

Legal Protections and Safeguards

The NDIS Quality and Safeguards Commission is responsible for ensuring providers comply with strict regulations, especially regarding restrictive practices. Participants and their families should feel confident that:

  • All restrictive practices are authorised and regulated.

  • They will be involved in decisions about their support.

  • Complaints or concerns about care can be raised through appropriate channels​​.
